To qualify, your child must have been born within the last 10 years and spent at least 7 days in the hospital after birth. The following diagnosed conditions are recognized by the courts:
Cerebral Palsy
A permanent movement disorder caused by brain damage before, during, or shortly after birth, often the result of oxygen deprivation during delivery.
HIE (Hypoxic Ischemic Encephalopathy)
A serious brain injury caused by the baby being deprived of oxygen during labor or delivery. HIE affects approximately 2.4 per 1,000 births in the U.S. and is one of the most common causes of newborn brain damage.
Extended NICU or Hospital Stay
Babies who remained hospitalized for 7 days or more following birth are considered to have suffered a serious birth event. A stay of 15 or more days significantly strengthens your claim.
Brain Damage at Birth
Any medically documented brain injury sustained during labor, delivery, or the immediate newborn period due to hospital or physician negligence.
Diagnosis requirement: Your child must have received a formal diagnosis of Cerebral Palsy, HIE, or brain damage. Autism-only diagnoses do not qualify for this claim.
